A fine and penalty points were imposed on a West Cumbrian motorist who prevented a police department from searching his car.
Jason Postlethwaite, 47, admitted the offense and a charge of using a vehicle – an Audi car – with defective brakes that made driving unsafe until the problem was resolved.
The defendant, from Barfs Syke, Distington, committed both offenses on Monday, October 18, the Workington Magistrates Court was told.
The search report stated that the police officer wanted to conduct a search under the Drug Abuse Act. The second offense concerned an Audi A4 which, according to the public prosecutor, had “problems with the vehicle’s brakes”. Both
A TUV test center had said the car should not be driven until this problem was resolved, the court heard, and therefore the use of the accused poses a potential danger or injury to any person.
The judges fined Postlethwaite £ 233 with a cost of £ 85 and a sacrifice surcharge of £ 34. They imposed three points on his driver’s license. Both crimes were committed in the Workington area.
